1. Intellectual Property Rights

1.1 Deliverables and Outputs

Upon full payment, the Client receives full ownership rights to the specific deliverables and final outputs created for this project ("Project Deliverables"). These include:

  • Final designs and prototypes

  • Delivered documentation

  • Final code and technical materials

  • Compiled user research findings

  • Final concepts and solutions

1.2 Excluded Items

The following items remain the exclusive property of EndUser:

  • Methodologies, processes, and techniques used during the project

  • Templates, frameworks, and tools developed prior to or during the project

  • Internal working documents and draft materials

  • Knowledge, expertise, and experience gained

  • Workshop structures and facilitation methods

  • Research methodologies and analytical frameworks

1.3 Rights to Deliverables

EndUser reserves the right to showcase the final Project Deliverables in their portfolio. If payment is not received as agreed, all intellectual property rights remain with EndUser, and the Project Deliverables may not be used or duplicated.

2. Payment Terms

2.1 Standard Payment Schedule

Where no deposit is required, the project fees will be invoiced in one instalment:

  • Due within 7 days of the invoice date

2.2 Projects with Deposit

The standard payment structure is:

  1. Initial Payment: 50% of the total project fee

  • Due within 7 days of project acceptance

  • Non-refundable except as per Cancellation Policy

  1. Final Payment: Remaining 50%

  • Due within 7 days of the invoice date

While this represents our standard payment structure, alternative payment arrangements may be agreed upon in writing between EndUser and the Client. In such cases, all other terms and conditions, including but not limited to intellectual property rights, cancellation policies, and delivery terms, remain in full effect regardless of the modified payment schedule.

2.3 Payment Terms

  • All invoices are due within 7 days of invoice date

  • Work will commence only upon receipt of the initial payment

  • Final deliverables will be released upon receipt of the final payment

  • Late payments may incur additional fees and delay the project timeline

3. Cancellation and Rescheduling

Cancellation Policy

  • With 6+ weeks notice: Full refund

  • With 4-6 weeks notice: 90% refund (10% fee applies)

  • Less than 4 weeks notice: 50% refund

Rescheduling

  • Requires minimum 2 weeks notice

  • Subject to availability

These terms and conditions form part of our agreement and are attached to all invoices. By proceeding with the project, you acknowledge and accept these terms.
